Materials. For the purpose of the Event, EAGE has requested You to send in video material of your presentation (“Materials“).
License. You will remain the owner of the Materials You have copyright of and EAGE will be allowed to use that content, free of charge. You grant to EAGE, and all its affiliated or group companies, an exclusive, royalty free, transferrable, irrevocable license to use the Materials for the purpose of the Event and to otherwise copy, use, publish and make available to other registered participants during the Publication period mentioned above.
Unless otherwise agreed, EAGE shall remove the Material from its systems and other storages after the Publication period.
EAGE has the right to decide at its sole discretion not to publish the Materials or to cease/withdraw the publication thereof, in which case EAGE is not liable for any costs and/or damages resulting from this decision.
Guarantees. You undertake and warrant that nothing prohibits the publication and exploitation of the Materials. You will be responsible for obtaining permission to use third party content as (part of) your Materials and for the agreed use by EAGE, including the making, publishing and otherwise exploiting of the Materials. The original source of such third party content should be acknowledged.
You also warrant that the Materials (1) do not contain any trade secrets, (2) nor contain libelous matter, (3) is not defamatory or obscene nor contain anything of political, discriminatory, sexual or otherwise abusive nature, (4) nor contain any faulty or illegal information, (5) nor information that brings EAGE or other third party into disrepute.
You shall ensure the Materials are free of viruses, harmful code and other disruptive technological means.
Exclusivity for limited period. During the Publication period You will not be allowed to publish, distribute or share the Materials other than still screenshots thereof to promote your Material by means of social media.
No liability. EAGE shall reasonably endeavor to avoid download, recording or other forms of copying or distribution of the Material outside the purpose of this consent but cannot guarantee this. To the fullest extent permitted by law, EAGE shall under no circumstances be liable for any direct or indirect, consequential, special, exemplary, incidental or punitive damages, such as loss of (future) profits or other economic loss, damages for delay, third party claims and suchlike caused by the exploitation, distribution or loss of the Materials.
Dutch law. This form is solely governed by and construed in accordance with Dutch law. Any disputes between You and EAGE can solely be brought before the competent court in Utrecht, the Netherlands.
